1. AGREEMENT TO TERMS

By accessing or using the AD Golf Center website (the “Site”), purchasing services, reserving simulator time, or enrolling in any membership program, you (“User” or “Member”) agree to be bound by these Terms and Conditions (“Agreement”).

If you do not agree to these Terms, you must discontinue use of the Site and services immediately.

AD Golf Center (“Company,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. Continued use of the Site or services constitutes acceptance of any revised Terms.

2. NATURE OF SERVICES

AD Golf Center owns and operates an indoor golf training and simulator facility in Gilbert, Arizona. Services may include, but are not limited to:

• Simulator rentals

• Lessons and training

• Membership programs

• Retail and related golf services

Certain services may be governed by separate Membership Agreements, which shall control in the event of any conflict with these Terms.

 

 

3. INTELLECTUAL PROPERTY

All content on the Site, including text, graphics, logos, images, video, and software (collectively, “Content”), is the exclusive property of AD Golf Center or its licensors and is protected under United States intellectual property laws.

You may:

• View and download limited content for personal, non-commercial use

You may not:

• Copy, reproduce, distribute, modify, or exploit any Content for commercial purposes without prior written consent

Use of the Site does not grant any ownership or license rights in Company intellectual property.

4. PURCHASES, MEMBERSHIPS, AND BILLING

4.1 Payment Authorization

By purchasing services or memberships, you authorize AD Golf Center to charge your designated payment method (“Payment Method”) for all applicable fees, taxes, and charges.

4.2 Recurring Membership Billing

If you enroll in a recurring membership:

• You authorize automatic monthly billing on your membership anniversary date

• Charges will continue until canceled in accordance with your Membership Agreement

• If the billing date does not exist in a given month, billing will occur on the nearest applicable date

4.3 Declined Payments

If a payment is declined:

• You have ten (10) days to provide valid payment

• Failure to do so may result in suspension or termination of services

• The Company may attempt to reprocess payments during this period

 

4.4 Fees

You are responsible for any fees charged by your financial institution, including overdraft or insufficient funds fees.

4.5 No Refund Policy

All purchases, including memberships, simulator time, and account credits, are non-refundable unless otherwise required by law.

5. USE OF THE SITE

You agree not to:

• Use the Site for unlawful purposes

• Interfere with Site functionality or security

• Transmit harmful, abusive, defamatory, or obscene material

• Violate the rights of others

You agree to indemnify and hold harmless AD Golf Center from any claims arising from your misuse of the Site.

6. DISCLAIMER OF WARRANTIES

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

AD GOLF CENTER DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY OF INFORMATION

Use of the Site and services is at your own risk.

 

7. LIMITATION OF LIABILITY

To the fullest extent permitted by Arizona law:

AD Golf Center shall not be liable for any indirect, incidental, consequential, or punitive damages, including:

• Loss of data

• Loss of profits

• Business interruption

Total liability shall not exceed the amount paid by you to AD Golf Center in the preceding twelve (12) months or $100, whichever is less.

Any claim must be brought within one (1) year of the event giving rise to the claim.

8. THIRD-PARTY LINKS

The Site may contain links to third-party websites. AD Golf Center:

• Does not control or endorse such websites

• Is not responsible for their content, accuracy, or policies

Use of third-party sites is at your own risk.

9. COMMUNICATIONS AND SUBMISSIONS

Any feedback, suggestions, or materials submitted to AD Golf Center:

• Become the property of AD Golf Center

• May be used without compensation or acknowledgment

• Must not violate any third-party rights or applicable laws

You grant AD Golf Center a perpetual, royalty-free license to use such submissions.

10. PRIVACY AND MINORS

Use of the Site is subject to our Privacy Policy.

We do not knowingly collect personal information from children under 13. By using the Site, you represent that:

• You are at least 13 years old, or

• You are using the Site under parental supervision

 

 

 

11. TERMINATION

AD Golf Center reserves the right to:

• Suspend or terminate access to the Site or services at any time

• Do so without prior notice for violations of these Terms

You may terminate your use at any time by discontinuing access.

12. GENERAL PROVISIONS

12.1 No Waiver

Failure to enforce any provision shall not constitute a waiver of rights.

12.2 Severability

If any provision is deemed invalid, the remaining provisions remain enforceable.

12.3 Entire Agreement

These Terms, along with any Membership Agreement and Privacy Policy, constitute the entire agreement between you and AD Golf Center.

13. GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Arizona.

Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to jurisdiction in such courts.

15. ASSUMPTION OF RISK AND LIABILITY WAIVER (GOLF & SIMULATOR USE)

15.1 Acknowledgment of Inherent Risks

You acknowledge that participation in golf-related activities, including the use of indoor golf simulators, practice equipment, training aids, and related facilities at AD Golf Center involves inherent risks of injury. These risks include, but are not limited to:

• Being struck by golf balls, clubs, or equipment

• Swing-related injuries or improper use of equipment

• Slips, trips, and falls within the facility

• Equipment malfunction or misuse by yourself or others

• Injuries caused by other patrons or third parties

You understand that these risks may result in serious bodily injury, permanent disability, or death.

15.2 Voluntary Participation

You voluntarily choose to participate in all activities at AD Golf Center with full knowledge of the risks involved and accept full responsibility for your participation.

15.3 Release and Waiver of Liability

To the fullest extent permitted by Arizona law, you hereby release, waive, and discharge AD Golf Center, its owners, officers, employees, agents, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to:

• Personal injury

• Property damage

• Loss or theft

• Death

whether caused by negligence or otherwise, arising from your use of the facility, equipment, or participation in any activities.

15.4 Indemnification

You agree to indemnify, defend, and hold harmless AD Golf Center from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

• Your use of the facility

• Your violation of these Terms

• Your negligent or intentional acts

15.5 Equipment Use and Responsibility

You agree to:

• Use all equipment safely and as intended

• Follow all posted rules and staff instructions

• Immediately report unsafe conditions or malfunctioning equipment

You assume full responsibility for any damage caused by misuse of equipment.

15.6 Physical Condition and Medical Fitness

You represent that you are physically capable of participating in golf and simulator activities and have no medical condition that would make participation unsafe.

AD Golf Center makes no representations regarding your physical fitness or ability to safely participate.

15.7 Supervision of Minors

If you are a parent or legal guardian of a minor using the facility:

• You consent to the minor’s participation

• You agree to supervise the minor at all times (unless otherwise agreed in writing)

• You accept all risks on behalf of the minor

• You agree to this waiver on the minor’s behalf to the fullest extent permitted by law

15.8 No Professional Instruction Guarantee

Any instruction, tips, or guidance provided by staff is offered for general informational purposes only and does not guarantee safety or injury prevention.

15.9 Insurance

You acknowledge that AD Golf Center does not provide health, medical, or accident insurance for participants. You are solely responsible for obtaining your own insurance coverage.

15.10 Arizona Law Compliance

This waiver is intended to be as broad and inclusive as permitted under the laws of the State of Arizona. If any portion is found unenforceable, the remaining provisions shall remain in full force and effect.
